A focus on legal stuff – what you will find

In the first of our whistle stop tour of the website we take a look at what you can find in the legal stuff section of the website.

Click below for an easy read version, or click ‘continue reading’ to see a non visual version.

Why Legal Stuff?

Because it is very confusing!

Our research is about people moving as part of Transforming Care, and many if not all of these people had been ‘sectioned’ under the Mental Health Act to allow them to be treated in hospital. This act has many different parts, and different parts mean different things – for example, whether someone has to stay in hospital, or whether they can move into the community (but still have some restrictions on their lives, for their and/or others’ safety).

Even for people who have not had any involvement with the Mental Health Act, a number of other legislations may come into play. Not least are our Human Rights, which affect everyone. Another act that should be considered is the Mental Capacity Act, which helps with decision making, and is often relevant to the lives of people with learning disabilities when they are living in the community.

What will I find here?

There is information here about the main legal frameworks which are important for people while moving or while living in the community, including:

  • The Mental Health Act
  • The Mental Capacity Act
  • The Care Act
  • Human Rights
  • The Equality Act

We have given some information but also linked to both accessible and full information about this legislation.
